Wingman Hosting is operated and controlled by Justin Mayer Group Inc.

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the wingmanhosting.com website (the "Service") operated by Justin Mayer Group Inc. t/a Wingman Hosting ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Wingman Hosting and its licensors.

2. Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Wingman Hosting

Wingman Hosting has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Wingman Hosting shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

3. Account Creation

You may create an account by signing up to our service. Our services vary in fee and pricing can be found on wingmanhosting.com

4. Account Information

You agree to maintain accurate and up to date records of all personal and business information. Registrars and other 3rd party providers require all information to be legal and up to date. Wingman Hosting will not be held liable for any misuse of your account or incorrect information within your account.

5. Account Security and Privacy

You agree to maintain your account and to use it in a safe and private manner. Your account cannot be used for any purpose other than the administration of your website and domains and anything involved within that administering under normal internet protocols. You are not allowed to hack, code, manipulate, change or tweak your account in any way. You must ensure that you keep your account safe from attack by following standard safe internet browsing habits and a strong password at all times.

6. Account Standing

You agree that to keep your account in good standing and services active you will pay the plans public fee at time of service start along with any desired add-ons, before or on the due date. Failure to pay on the due date of each invoice may result in your account being terminated. Not paying your invoice on the due date is a breach of these terms. If you are unable to pay your invoice for any reason please let support@wingmanhosting.com know ASAP. If you fail to pay your invoice on or before the due date and fail to notify us, you will be charged a late fee of $25 should you wish to pay to regain your wingman hosting services.

7. Passwords

You agree to use strong passwords, preferably something with a strength of 75 or greater. You can check your passwords strength here https://www.my1login.com/resources/password-strength-test/

Wingman Hosting will not be held liable for the misuse and poor choice of any users password. Failure to create a strong password and to keep it private is taken at your own risk.

8. Content

You agree that you are responsible for the content you upload. Wingman Hosting will not be held liable for any content that is unlawful, illegal or lacking the rights and ownership necessary for storing, transmitting, transferring or other of any content or files or other you host on our services. Wingman Hosting does not check your content unless you are using it in a manner outside of these terms and conditions, as a matter of privacy. If we receive complaints we reserve the right to check on the content in question and even terminate the account if such content is deemed to be outside the boundaries of these terms. You may not used wordpress or shared hosting plans for reseller services. You may host clients websites if you also own the domain and it is transferred to Wingman Hosting. To offer reseller services we recommend using dedicated servers. Cpanel/WHM comes installed and ready to use on our dedicated servers, along with management are included in the monthly price.

9. Backups

Wingman Hosting makes 4 backups per week of some services. Backups are compressed data files stored on hardware and therefore have a small chance of failure due to data corruption and therefore each backup cannot be guaranteed to work. A backup not working is extremely rare. Wingman Hosting is not liable for a backup being corrupted or unable to restore. Wingman Hosting will do everything it can to solve the issue and help you restore the backup but it cannot guarantee the validity of the data or the backup or it working.

10. WebExpert Assist

Web Expert Assist is an added paid service provided by Wingman Hosting for anyone who wants help with their Websites technical aspects. Technical aspects can include but are not limited to websites being down, 404 errors, server not responding, website corruption, malware, plugins broken. WebExpert Assist cannot guarantee it will resolve the problem or diagnose it. In an instance where Wingman Hosting does not solve the problem or provide a detailed description of the problem, refunds are negotiable at Wingman Hostings sole discretion. WebExpertAssist must be paid in advance. Pricing is $95/hour charged in 15 minute increments.

11. Disclaimer of Warranties

9.1) Uptime: Wingman Hosting is based on a complex network of people administering and managing hardware and its software, all which need to be maintained and updated in order to provide the service.

This means that not all services will always be available.

Wingman Hosting offers 99.9% Up-Time. This is valid for only the Wingman Hosting servers and any software and 3rd party apps, scripts and software stored on Wingman Servers. Wingman has partnered with service providers who install server hardware in datacenter racks. Our partners offer 100% uptime however Wingman Hosting is not responsible for any downtime caused by any provider's hardware or network malfunction which is outside of Wingman Hosting capability to directly correct. Wingman Hosting clients are diverse and their websites and the function of those websites are diverse and Wingman Hosting cannot be held responsible for any service interruption due to client's error, including but not limited to spamming, the target of a DDOS attack, or any other internet or cyber attack or personal misuse including but not limited to corrupted plugins, code, apps, scripts or other or any malware or other spyware or pirate asset that may or may not cause downtime, data loss, intrusion, hackers or theft.

9.2) Non-infringement, merchantability, fitness for a particular use: WINGMAN HOSTING MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE) WITH RESPECT TO THE SERVICES IT PROVIDES. Neither Wingman Hosting nor anyone else involved in the provision of Service is liable to you or any third-party for direct or indirect damages resulting from the use, non-use of services provided herein, whether or not such damages resulted from the negligence of Wingman Hosting, even if Wingman Hosting has been advised to the possibility of such damages.

9.3) Unlimited Storage: Wingman Hosting provides unlimited storage for certain plans, but does maintain limits on the amount of inodes being used. Inodes are simply data files. It takes a lot of Websites and/or files to reach 400,000 inodes. If you need more than 400,000 inodes per month, please contact support@wingmanhosting.com to receive our special offers which allows you to scale with Wingman.

The inode restrictions are as follows.

Amateur: 100,000 Professional: 200,000 Master: 300 000

When you reach your limit your website will not stop working. Your emails will still work and your Websites will stay up and active.

However Inode overage charges will apply, due on your next payment cycle up to the day previous to billing date.

Inode overage charges are $5 / 10,000 inodes.

Overages are charged in intervals of 10,000 inodes.

These overage charges will continue to apply until you either 1) clean up your account to remove uneeded and unnecessary inode files or 2) upgrade to the next account up or 3) contact support@wingmanhosting.com to add an inode package on to your plan.

9.4) Unlimited Bandwidth: Wingman Hosting is not actively tracking your bandwidth usage. It provides unlimited bandwidth within the normal use of your Account and/or Website or Websites. This does not include file sharing websites, pirate sites, illegal or unlawful sites or anything not in accordance with the terms herein or the governing law. Wingman Hosting reserves the right to monitor your bandwidth in instances of suspicious traffic, large spikes, complaints, or any other reason that may lead Wingman Hosting to believe there is a misuse of its services.

9.5) 100% Renewable Energy: Our servers are hosted in Compass datacenters in Montreal, QC CANADA. They are connected to a power grid that is powered solely by renewable electricity. We have zero servers in carbon powered datacenters.

12. Dedicated IP’s

Some plans come with a free dedicated IP. All plans will be originated with a shared IP. To use your dedicated IP you must request.

Wingman Hosting owns and operate the IP addresses assigned to you at all times and reserves the right to rename or reassign at any time.

13. Site Transfers

Wingman Hosting offers FREE initial site transfers. While this is usually a smooth and easy process there are a lot of variables in Websites that we cannot account for and there are certain instances where we are not able to help with a site transfer. Wingman Hosting also cannot guarantee how the site transfers as occasionally some sites can get broken when they are transferred. Wingman Hosting will make every assurance to transfer your site without problem using industry best practices but cant be held liable should there be a failure outside of the control of Wingman Hosting. Site transfers must be requested within 30 days of service start to be valid for FREE transfer rate. Any transfer requested outside of the 30 day window on new accounts will be subject to normal transfer fees.

14. Support Guarantee

Wingman Hosting will do our best to reply to support tickets within 1 hour. Our goal is to respond ASAP and our main mission is to do it within 1 hour. Often times it is much faster than 1 hour. Wingman Hosting however cannot control every email, where it is sent from, the live chat having a technical issue and any other reason that may cause your ticket, email, chat etc. to not arrive in our inbox. While we have never missed a support ticket or had a problem with our chat, there is a chance that there might be a technical issue that we cannot control. Therefore, Wingman Hosting can only guarantee we reply within 12 hours. If we do not respond within 12 hours you are able to get a credit for 1 week of service. If you have not gotten a response within 1 hour we recommend you try again. Your 12 hours will start at the time the first request for help was received.

15. Money Back Guarantee

If you are not happy with our service for any reason you may get your money back. To be eligible to get your money back you must notify us in writing via a support ticket within thirty days of your service start.

16. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

17. Acceptable Use

You agree to use Wingman Hosting services in accordance with the law. You may only use your service for your hosting and its requirements, you are not allowed to use your hosting for storage. Wingman Hosting can provide optional storage for an affordable price by contacting us at support@wingmanhosting.com .

18. WebExpert Assist

Web Expert Assist is an added paid service provided by Wingman Hosting for anyone who wants help with their Websites technical aspects. Technical aspects can include but are not limited to websites being down, 404 errors, server not responding, website corruption, malware, plugins broken. WebExpert Assist cannot guarantee it will resolve the problem or diagnose it. In an instance where Wingman Hosting does not solve the problem or provide a detailed description of the problem, refunds are negotiable at Wingman Hostings sole discretion. WebExpertAssist must be paid in advance. Pricing is $95/hour charged in 15 minute increments.

19. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

20. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

21. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

22. Force Majeur

Wingman Hosting will do everything it can to maintain online services and websites, however in instances of force majeur Wingman Hosting cannot be held liable for failure of services and websites. Force Majeur are things like natural disasters and acts of God.

22. Email Packages

Wingman Hosting offers different packages for Email depending on the plan. See pricing tables for which Email package applies to which Hosting Plan. You agree to not misuse your email accounts and not leave unnecessary emails stored on your servers or account. Instead backup your emails offline.

Email Basic – 1 GB per mailbox | 10 Email Accounts | 50 Outgoing Emails per Hour

Email Advanced – 2 GB mailbox | 25 Email Accounts | 200 Outgoing Emails per Hour

Email Pro – 5 GB mailbox | 50 Email Accounts | 500 outgoing Emails per hour

Email Master – Unlimited
